Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites and services offered by CreatorCompli ("CreatorCompli," "we," "us," or "our"), including creatorcompli.com and any related subdomains (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract under applicable law. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

2. The Service

CreatorCompli provides automated FTC disclosure compliance scanning for influencer marketing content. The Service uses AI and pattern-matching to evaluate social media posts against the FTC Endorsement Guides (16 CFR § 255) and similar consumer-protection rules, and produces advisory reports including estimated penalty exposure.

The Service is an informational tool and does not provide legal advice. Compliance evaluations are best-effort, probabilistic, and based on publicly available information. You are solely responsible for your own compliance with FTC rules and other applicable laws. Consult qualified counsel for advice on your specific situation.

3. Accounts

You must provide accurate information to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@creatorcompli.com if you suspect unauthorized access.

4. Subscriptions, billing, and refunds

Paid plans renew automatically on the cadence you select (monthly or annual) until you cancel. Cancellation takes effect at the end of the current billing period; you retain access until then. Fees are non-refundable except as required by law, or at our sole discretion for goodwill in extraordinary circumstances.

We reserve the right to change pricing with 30 days' notice to active subscribers. If you do not agree, you may cancel before the change takes effect.

You authorize us and Stripe to charge your payment method for all fees incurred, including overage fees for usage beyond your plan's allocation.

5. Acceptable use

You agree not to:

  • Use the Service to harass, defame, or impersonate any individual or entity.
  • Attempt to reverse-engineer, scrape at scale, or resell the Service without prior written consent.
  • Upload content that you do not have the right to submit for analysis.
  • Submit content that is unlawful, malicious, or designed to mislead our detection systems.
  • Use the Service to compete with us or to build a substitutable competing service.
  • Circumvent rate limits, scan quotas, or other technical restrictions.

We may suspend or terminate accounts that violate these rules. In serious cases we may also report activity to law enforcement.

6. Content ownership + license

You retain all rights to content you submit (captions, transcripts, handles). You grant us a non-exclusive, worldwide, royalty-free license to process that content as needed to provide the Service — including transmitting it to our AI provider, storing scan results, and aggregating anonymized statistics.

Scan results, reports, and compliance badges generated by the Service are yours to use within your marketing and business operations. The software, models, prompts, and Service infrastructure remain our property.

7. Compliance badges

Public verification pages at creatorcompli.com/verify/<handle> display a compliance status based on scans tied to the handle you've registered. We reserve the right to revoke or modify a badge if we detect misuse, inaccurate self-reporting, or evidence of non-compliant behavior. Displaying a badge does not constitute certification by any regulatory body.

8. Outreach to non-subscribers

As part of the Service we scan publicly available content and may send commercial outreach to creators or brands identified as having potential compliance issues, in compliance with the CAN-SPAM Act. Every such message includes our physical mailing address and a functional unsubscribe link. Recipients may also request removal at any time by contacting privacy@creatorcompli.com.

9. Third-party services

The Service integrates with third-party providers (Clerk, Stripe, Resend, Anthropic, Neon, Vercel, Railway, YouTube Data API, and others). Use of those providers is subject to their own terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF OUTPUTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Compliance evaluations, penalty estimates, and badge statuses are informational only. We make no guarantee that content evaluated as "compliant" by the Service will be found compliant by the FTC or any other regulator.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATORCOMPLI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You will indemnify, defend, and hold harmless CreatorCompli from any third-party claim arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, abuse the Service, or create risk for us or other users. Sections that by their nature survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will remain in effect.

14. Governing law + disputes

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Buncombe County, North Carolina, and you consent to the exclusive jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. The "Effective date" above reflects the latest version. Continued use of the Service after changes take effect constitutes acceptance.
